Despite the apparent relationship between personal values and entrepreneurship, this topic t has been subject to little academic research. This article aims to explain, in the Brazilian context, how the personal values of entrepreneurs influence the degree of professionalism in their business. The article uses a descriptive and exploratory quantitative approach, with data collected via a survey and focus group. Results show that, in the Brazilian context, ethics and capitalist values have a greater influence on professionalism than do risk, innovation, (...) family history, etc. Certain personal values of small-business entrepreneurs become organizational values that drive their actions in challenging environments. The finding that only one of the ten independent variables has been considered statistically influential on professionalism constitutes its main theoretical contribution. It rethinks professionalism, no longer as a dependent variable, but as a personal value, like the rest, in independent, innovative and sovereign way. (shrink)

Among the many ways to evaluate the rationality and adequacy of belief, the relationship between two dimensions is of particular interest: the epistemic dimension and the moral dimension. A belief is epistemically rationalwhen it is supported by the evidence and it is morally adequatewhen its formation and holding is sensitive to moral features of the situation. According to the traditional view, known as purism, the moral domain does not directly impact the epistemic domain. However, there is debate in the literature (...) about the existence of immoral beliefs that seem, at first sight, epistemically rational. These beliefs that contain apparent normative conflict raise the challenge of explaining how different forms of normativity are related. Non-traditional theories hold that there is an encroachment of moral factors in epistemic rationality. Moral encroachment is the view that moral features can affect the epistemic status of a belief, for example, influencingthe threshold of sufficient evidence for rational belief. This idea produces a natural answer to the conflict problem: it wouldn’t exist because moral contexts make immoral beliefs also epistemically irrational. In this paper, I’ll argue that immoral beliefs can’t be epistemically rational, so there is no conflict. This, however, is not due to moral encroachment. It happens because immoral beliefs are never actually supported by the evidence. They are immoral because they are insensitive to moral contexts andepistemically irrational because they are insensitive to available evidence. This account is compatible with purism and, since it is the most parsimonious theory, we should adopt purism. (shrink)

The suggestion that emotions are, in a way, essential to moral judgement has been getting attention in recent literature. Jesse Prinz says that emotionist theories involve at least one of the following claims: (i) emotions are necessary and sufficient for the acquisition of moral concepts (epistemic emotionism); (ii) emotions are necessary and sufficient to determine moral properties (metaphysical emotionism). According to Prinz, some empirical results in moral psychology can support these kinds of emotionism (especially the first one). In The emotional (...) construction of morals, Prinz presents the famous dumbfounding cases, in which interviewees maintain a moral judgement even when confronted with the fact that they cannot articulate reasons why, as evidence for an emotionist view of moral judgement. There is, however, controversy regarding the interpretation of such cases: to begin with, it seems possible to interpret them through reasons, as suggested by Sinott-Armstrong, Yin and Stanley (2019); also, even if there are no reasons being considered, it is possible, as suggested by Jones (2006) and Alves (2013), that dumbfounded moral judgement isn’t a genuine example of moral judgement, since the subjects do not possess basic moral concepts. I start with moral dumbfounding cases and Prinz’s emotionist interpretation of them and later consider the alternative interpretations. Even though Prinz’s reading is initially appealing, it seems the empirical evidence does not support a sentimentalist metaethics as much as he suggests, and the appeal to reasons is still essential in understanding moral judgement. -/- . The first contribution, by Mercedes Valmisa, begins by repositioning the Zhuangzi 莊子 as a whole within pre-Qin thought under the impact of newly excavated materials. Moving away from the traditional classification of texts according to schools, it focuses instead on varying approaches to life issues. Centering the discussion on life situations and changes we have no control over, including the unpredictable vagaries of fate (ming 命), it outlines several typical responses. One is adaptation, finding ways to go along with (...) what life demands, and even availing oneself of the new opportunities it brings about. Another is a turning inward, a focus on the inner self, holding on to ethical and other standards and making sure on does the right thing regardless of the outcomes of one's actions. While the former appears in several chapters of the Zhuangzi, notably in chapter 6, the latter is central to the Qiongda yishi 窮達以時 (Failure and Success Depend on Opportunity), a manuscript excavated at Guodian. However tempting it may be to characterize one approach as Daoist and the other as Confucian, they both appear within the Zhuangzi together with a third approach to fate, showing the fluidity of philosophical discussion and the futility of thinking along the lines of traditional boundaries. Philosophy of action in the context of Classical China is radically different from its counterpart in the contemporary Western philosophical narrative. Classical Chinese philosophers began from the assumption that relations are primary to the constitution of the person, hence acting in the early Chinese context necessarily is interacting and co-acting along with others –human and nonhuman actors. This book is the first monograph dedicated to the exploration and rigorous reconstruction of an extraordinary strategy for efficacious relational action devised by Classical (...) Chinese philosophers in order to account for the interdependent and embedded character of human agency –what the author has denominated “adapting” or “adaptive agency” (yin 因). As opposed to more unilateral approaches to action also conceptualized in the Classical Chinese corpus, such as forceful and prescriptive agency, adapting requires great capacity of self and other-awareness, equanimity, flexibility, creativity, and response, which allows the agent to co-raise courses of action ad-hoc: unique and temporary solutions to specific, non-permanent, and non-generalizable life problems. Adapting is one of the world’s oldest philosophies of action, and yet it is shockingly new for contemporary audiences, who will find in it an unlikely source of inspiration to deal with our current global problems. This book explores the core conception of adapting both on autochthonous terms and by cross-cultural comparison, drawing on the European and Analytic philosophical traditions as well as on scholarship from other disciplines, opening a brand-new topic in Chinese and comparative philosophy. Mercedes Valmisa turns our attention to the relations between truth and practice in classical Chinese philosophy. In this tradition, truth is conceived of, in a pragmatic-like spirit, as a series of embodied beliefs and perspectives that lead to fitting dispositions, emotions, and actions (regardless of whether they accurately describe the world, or whether there are other competing beliefs and perspectives that equally accurately or inaccurately describe the world). This means that we should care about truth because of its normative (...) power to guide our behavior in the most fitting way, not because of a theoretical interest in accurately describing reality. Valmisa Oviedo traces the development of this conception of truth in the Mohists and Zhuangists, leading to two radically different sociopolitical and ethical positions: the Mohists used single-truth discourses to enforce ideological monopolies that could not allow pluralism in values, norms, beliefs, and practices, while the Zhuangists warned us against the dangers of such dogmatism. The article examines the first Hebrew Encyclopedia of Science, Yesodei ha-Tvunah u-Migdal ha-Emunah, by Medieval Jewish scholar Abraham Bar Hiyya from Saragossa (Iberian peninsula).

Thomas Aquinas wrote a text later known as Quaestio de attributis and ordered it inserted in a precise location of his Commentary on the Sentences of Peter Lombard more than a decade after composing this work. Aquinas assigned exceptional importance to this text, in which he confronts the debate on the issue of the divine attributes that swept the most important centres of learning in 13th Century Europe and examines the answers given to the problem by the representatives of the (...) four mainstream schools of his time: the Greek mystic Dionysius Areopagita, the Latin Saint Anselm of Canterbury, the Jewish rabbi Moses Maimonides and the Muslim philosopher Ibn Sina. This in-depth study of Thomas Aquinas’ Quaestio de attributis (In I Sent., d. 2, q. 1, a. 3) binds together the findings of previous research on the unique history of this text by reconstructing the historical circumstances surrounding its composition, shows that the Quaestio contains Aquinas’ final answer to the dispute on the divine attributes, and thoroughly examines his interpretation of Maimonides’ position on the issue of the knowledge of God by analysing this and other texts related to it chronologically and doctrinally. The examination of the Quaestio reveals the background of Thomas Aquinas’ renewed interest in Maimonides’ position on the issue and brings to light elements of Aquinas’ interpretation that are absent from his earlier references to Maimonides. Moreover, the chronological and doctrinal connection of the Quaestio de attributis to other Thomistic works with explicit references to Maimonides enables a reconstruction of his comprehensive approach to Maimonides’ teaching on the possibility and extent of the knowledge of God in the Guide of the Perplexed and highlights the place of Maimonides’ philosophical teachings in Thomas’ own thought in issues like "Being" as the proper name of God, the multiplicity of the divine names, the beatific vision in the afterlife, the causes that prevent the instruction of the multitude in divine matters and the role of faith and prophecy in the acquisition of the true knowledge of God in this life. The last chapter examines the reasons behind Aquinas’ silencing of Maimonides’ name when introducing his Five Ways for the knowledge of the existence of God, in spite of the evident relation between these and Maimonides’ Four Speculations. The study is completed with an extensive appendix that includes the text of the Quaestio de attributis with an English translation and the critical edition of several chapters of the 13th Century Latin translation of the Guide of the Perplexed known as Dux neutrorum. This chapter presents an analysis of Wang Bi’s (226-249 CE) hermeneutics and reception theory via the concept of “forgetting” (wang 忘) in his essay “Clarifying the Images” (Ming xiang 明象).

研究早期中国哲学的学者均普遍认为，缺乏作者和思想学 派的资料，对以哲学为本的研究非常不利。就着这个观点，本文提出异议: 汉学研究所提供的文献、文学、语言、历史的知识，可融贯于早期中国哲学 的研究，并产生良好的影响。蒋韬在 2016 年提出了“汉学挑战”的论述。就此，本文论证，汉学正好 提供一个机会，结合不同的研究方法及角度，从而更有效地处理具体的哲 学议题。我以自己对“命”的研究为例，解释如何以多个文本为基础，梳理 哲学问题，做“没有作者的哲学”，并显示:融贯汉学研究所提供的各种方 法、知识、研究工具，不仅无损哲学研究，更为其注入新气象。我采取了“后学科”的研究角度:受到前学科文化(例如早期中国文 化)的启发，“后学科”的角度在提问时，往往从整体出发，不囿于各个学科 的既定模式和分类;并开辟新路向，容纳创意，追寻意义，以产生可行的新 联系。 Some scholars of early Chinese philosophy see the knowledge provided by Sinology as a challenge to the development of sound philosophical enquiry. What Sinology tells us about the historical context and the textual, material, and intellectual culture of the period is considered detrimental for engaging in philosophical research, reason why these scholars believe that Chinese philosophy must separate itself from Sinology. I argue that Sinology does not offer (...) a challenge but an opportunity to engage with a multitude of approaches and methods to more efficiently address philosophical problems and questions. I offer my own research as an example of how to integrate the knowledge and analytical tools offered by Sinology in a philosophical study of early China. Focusing on the most crucial Sinological challenge--the challenge to the notions of “book” and “author"--I show that using the methods and knowledge provided by other disciplines does not jeopardize but, much to the contrary, invigorates and revitalizes philosophical research. My perspective is post-disciplinary: inspired by pre-disciplinary cultures such as early China, post-disciplinarity engages inquiry holistically, suspending the patterns and categories established by discrete disciplines, forging new paths for creativity and the search of meaning, and allowing new viable connections to emerge. Early Chinese texts make us witnesses to debates about the power, or lack thereof, that humans had over the course of events, the outcomes of their actions, and their own lives. In the midst of these discourses on the limits of the efficacy of human agency, the notion of ming 命 took a central position. In this article, I present a common pattern of thinking about the relationship between the person and the world in early China. I call it the (...) reifying pattern because it consisted in thinking about ming as a hypostasized entity with object-like features. Although external and independent, ming was not endowed with human qualities such as the capacities for empathy, responsivity, and intersubjectivity. The reification of fate implied an understanding of ming as an external, amoral, and determining force that limited humans without accepting intercommunication with them, thereby causing feelings of alienation, powerlessness, and existential incompetence. I first show that the different meanings of ming hold a sense of prevailing external reality, and hence can be connected to the overarching meaning of fate. Then, I offer an account of the process of reification of fate in early China and its consequences, theoretical and practical, through cases study of received (Mengzi 孟子) and found (Tang Yu zhi dao 唐虞之道) texts. I end with some reflections on the implications of ming as a nonpersonal and nonsubjective type of actor for both early Chinese and twenty-first-century accounts of agency. (shrink)

This paper leads us in reflections regarding the ontological status of a situation inspired by two main sources: the Zhuangzi--a multifarious compilation from Warring States China (ca. 4th c. BCE)--and José Ortega y Gasset's (1883-1955) Unas Lecciones de Metafísica (Some Lessons in Metaphysics)--the transcripts of a course on metaphysics by a Spanish philosopher of the early 20th century. Much as other ontologically subjective entities and events, situations do not preexist the intentional subject: instead, they are created alongside our act of (...) noticing. In Classical Chinese, shi , commonly rendered "propensity" and the closest the language comes to our concept of situation, denotes a dynamic process that incorporates the conscious subjective agent as well as other entities as constitutive elements. Here a situation is not reducible to the discrete phenomena and events that we can discern within a given space-time; rather, it necessitates our thinking about it to arise. These ontological reflections are important for a philosophy of action. They help us notice the role of attention in the creation of situations--as in the creation of worlds--hence the importance of understanding what the agent notices and fails to notice, what we privilege as worthy of our attention and what passes inadvertent among the world's plural affordances. The relational affordances that we actualize and reify as constituting a situation depend on what we are socialized and educated to see when looking at the world, thus situations and agents co-create one another over time. This acknowledgement is crucial to retrain our agency in order to illuminate our blind spots, overcome our uncritical certainties which generate absolutist tendencies, and move beyond fixed, reduced, and contingent corners from which to interpret the world. Philosophers sometimes wonder whether academic work can ever be truly interdisciplinary. Whether true interdisciplinarity is possible is an open question, but given current trends in higher education, it seems that at least gesturing toward such work is increasingly important. This volume serves as a testament to the fact that such work can be done. Of course, while it is the case that high-level theoretical work can flourish at the intersection of dance and philosophy, it remains to be seen how we (...) might share this with undergraduate students. For many of us in philosophy and dance, a large number of the students we teach are neither philosophy nor dance majors. As such, we are familiar with the challenge of convincing our students to care about our fields. Both philosophy and dance, qua disciplines on a college campus, face similar challenges. These disciplines are often deeply misunderstood, frequently presumed to be “impractical” (a powerful, but confused objection), intimidating, and frivolous. In this chapter, we offer an account of the course we co-taught at Southern Utah University in the Spring of 2016 titled “Movement and Space” as a rough framework for how to introduce the intersection between philosophy and dance to students. We simultaneously attempted to break students of their misconceptions about philosophy and dance, and worked to engage students and professors alike in a truly interdisciplinary educational experience. Treating philosophy as an embodied endeavor, and employing philosophical concepts through the act of dance encouraged students and faculty alike to rethink the fundamental nature of aesthetics. Moral subjectivism is commonly associated with out-of-favour theories like, e.g., Alfred Ayer’s emotivism or John Mackie’s error theory. This paper approaches the field against the background of the attitudinal character of morality and religion. The possibility of a brand of moral subjectivism is established which is common to Ayer’s and Mackie’s theories in name only yet still has significant merits. The perspective from action theory and the philosophy of mind suggests that the problem of moral obligation, central to moral philosophy, (...) is more convincingly dealt with by subjectivism than by its rivals: In contrast to realism or even relativism (with which subjectivism is often confused), subjectivism can help to explain the peculiarities of obligation without forcing us to disregard the parallel problem in the field of religion. This finding calls into question the rationale for, as well as the success of, central assumptions in ontology and semantics which the realist so freely hands out in order to make his point: If religious facts and the truth-aptness of religious judgements will not explain religious obligation, moral facts and the truth-aptness of moral judgements will not help the moral realist either. So unless we do not wish to simply cast the problem of moral obligation aside, in future, moral subjectivism must be seriously considered as a worthwhile position in its own right. This study tries to identify the core elements of the teaching of Albert the Great on the possibility of a natural knowledge of God and its sources in the negative theology of Pseudo-Dionysius Areopagite.

What is discrimination and what makes wrongful discrimination wrong? Even after an ever-rising tide of research over the course of the past twenty-five or so years these questions still remain hard to answer. Exercising candid and self-critical hindsight, Larry Alexander, who contributed his fair share to this tide, thus remarked: “All cases of discrimination, if wrongful, are wrongful either because of their quite contingent consequences or perhaps because they are breaches of promises or fiduciary duties.” If this is true it (...) raises serious doubts as to how wrongful discrimination can be a moral wrong in itself. Also, the question comes up as to who it is who breaches a promise or a fiduciary duty. This paper defends the view that the substance of these remarks is better understood by couching them in a political approach towards discrimination. Against this background, they give rise to real and pressing concerns. Once we conceptualise the realm political along Hobbesian lines as the battleground comprising both the private sphere of the individual and the public sphere of the commonwealth it emerges that discrimination has different significance with regard to these respective spheres. In order to illustrate this, I adopt Kasper Lippert-Rasmussen’s descriptive account of discrimination as „differential treatment on the basis of membership of a socially salient group“ and the common view that wrongful discrimination is wrong because it is harmful, disrespectful, or both. In the private sphere the case can be made for morally permissible cases of discrimination. Sexual discrimination due to sexual self-determination with consequently freely choosing your sexual or romantic partner is the central case in point. Where somebody feels unfairly rejected and consequently hurt neither the charge of harm inflicted nor that of disrespect endured need be justified. No “breach of promises or fiduciary duties” is involved. The case is different, however, when it comes to the fiduciary of power. In discriminating, he who exercises the power of the commonwealth necessarily breaches a promise and a fiduciary duty. Discrimination thus appears to be more of a problem of political philosophy than one of applied ethics. In der privaten Sphäre kann es nun Fälle moralisch zulässiger Diskriminierung geben. Zentral ist die sexuelle Diskriminierung aufgrund der Ausübung einer freien Wahl des eigenen Sexual- oder Liebespartners. Anders im Fall staatlicher Diskriminierung: Ein „breach of promises“ oder eine Verletzung „fiduciary duties“ liegt hier stets vor, da Fälle staatlicher Diskriminierung regelmäßig Machtmissbrauch darstellen: Der Inhaber staatlicher Gewalt verletzt die Treuepflicht, das Mandat unparteilich auszuüben, das getreulich auszuführen er gelobt hat. The paper unfolds a non-modal problem for (moderate) meta-linguistic descriptivism, the thesis that the meaning of a proper name (e.g. ‘Aristotle’) is given by a meta-linguistic description of a certain type (e.g. ‘the bearer of “Aristotle”’). According to this theory, if ⌜α⌝ is a proper name, it is a sufficient condition for the name’s being significant that the description ⌜the bearer of ⌜α⌝⌝ is significant. However, a quotational expression may be significant even when the expression quoted is not. Therefore, proper (...) names and their corresponding descriptions cannot be synonymous, and the corresponding descriptions cannot be viewed as giving the meanings of proper names. So, even if it was immune to Kripke-style modal criticisms, moderate meta-linguistic descriptivism would still seem to founder on the rocks of the opacity of quotation. (shrink)

The reception of the translations of Aristotelian and pseudo-Aristotelian works at the University of Paris in the thirteenth century promoted a new understanding of the sciences as specialized fields of knowledge. The huge amount of translations required a new organization of knowledge, which included novel subjects and categories. Among these there is a very special case, namely the pseudo-Aristotelian De plantis, translated from Arabic into Latin and then back into Greek to be re-translated into Latin again. De plantis was included (...) in the new curriculum in Ripoll 109, and constituted the main source for botanical studies until the sixteenth century. Throughout this paper we will explore the reception and impact of De plantis in both the Arabic and the Latin traditions. We aim to show its foundational role in the development of botany as a theoretical discipline within the natural sciences. (shrink)

Philosophical action theory seems to be in pretty good shape. The same may not be true for the study of human action in economics. Famous is the rant that the study of human action in economics gives reason to tremble for the reputation of the subject. But how does this come about? Since economic action is about action, the broader study must surely have a strong impact on the more specific field. The paper sets out, from the ground up, how (...) an essential concept in economic theory–the concept of competition–can fundamentally benefit from insights derived exclusively from analytical action theory broadly conceived. In doing so, the paper delivers on an old Austrian promise: it is sometimes claimed that Austrian economists understand competition better than most economists. This may be a bold claim, since Austrian economists have neither traced the understanding of subjectivity to its very origin (the theory of intentionality), nor have they traced their sympathy for methodological individualism in relation to market processes to its very ground (the theory of (human) action). This paper aims to fill this gap. Moreover, by grounding an Austrian view of competition in analytic action theory, it succeeds in avoiding the serious problems of the dominant equilibrium approach. By explaining competition as rivalry, the paper draws on the philosophy and logic of human action to bring the (economic) agent back into play. In this way, a case is made for an integrated view of Austrian theory as an amalgam of Austrian economics and analytic action theory. (shrink)

Adam Smith said that ‘the propensity to truck, barter and exchange one thing for another is common to all men, and to be found in no other race of animals.’ Smith addressed the mark of the man economical, and there is no denying that this is the peculiar way he acts: clearly, to truck, barter and exchange is to act in a certain way. Austrian economics adopts this way of looking at the realm of economics. It prides itself as a (...) theory of human action. This claim seems ill-founded as long as so important a contribution as Ludwig von Mises’s praxeology remains insufficiently understood. In this paper, I address Barry Smith’s charge that in praxeology ‘other core notions, in addition to the concept of action, have been smuggled into and the theory is therefore not purely analytic’. I offer logical proofs of two cornerstone theorems of praxeology, the uneasiness theorem and the scarcity theorem, and thus provide vindication. Also, the findings support Mises’s controversial claim that economics is a priori founded in action theory. Thus, Carl Menger’s dream to lay foundations to economics and the other social sciences may have come true in the guise of praxeology. (shrink)

The theory of the just price is commonly assumed to have three sources: Political philosophy of Greek antiquity, scholastic ethics of the High Middle Ages, and the Roman law of obligations of late antiquity. While closer inspection confirms this holds for the first two worlds of thought the latter assumption seems ultimately unfounded. The paper claims that the evidence notoriously presented on behalf of that assumption – two rescripts attributed to Roman emperor Diocletian, namely Codex Iustinianus 4.44.2 and 4.44.8 – (...) ultimately points in another direction. Offering both an analysis and an alternative reading of the rescripts an integrated interpretation is given that reconciles them with the “liberalistic spirit of Roman law”. Also, it is explained why, from the point of view of legal and social philosophy, the fact that Roman law refrains from introducing a moral aspect to the institute of price fixing speaks in favour of Roman law rather than against it. Much of what has been discussed in the theory of reference in the last twenty-five years is strongly influenced by considerations centring on the business of devising a semantics for quantified modal logic. In this context, discussion of the property of rigidity plays an important role. This property is conceived of as a semantic modal property that distinguishes proper names from descriptions. It is argued that there is a semantic modal asym- metry between expressions of these types. In this talk (...) I shall challenge this assumption. By examining the intuitive Kripkean argument or test employed I arrive at two rather nonconformist results: Firstly, it seems that the test does not establish a genuine semantic asymmetry: Rigidity appears to be a pragmatic property. Secondly, the test does not seem to demonstrate an asymmetry at all: When applied correctly it suggests that both proper names and descriptions (even discounting notorious cases like “the even prime”) can be used rigidly—or so I shall argue. Wo wir Gewissensfreiheit missachten, erlegen wir Individuen unzumutbare Gewissensnöte auf Der Laizismus bewahrt damit die Unverletzlichkeit religiöser Einstellungen. Gewissensfragen gibt es jedoch nicht nur in der Religion. Es gibt sie auch in (...) der Moral, und sogar in individuellen Lebensperspektiven und Weltanschauungen jenseits von Religion und Moral. Wer Denkern wie Jefferson und Humboldt folgen will, muss daher weiter gehen. Der Aufsatz entwickelt die Konsequenzen für einen in Hobbes und Locke gründenden Kontraktualismus. Gewissensfreiheit zu missachten zerstört daher das politische, das „Locke'sche" Vertrauen, welches das Gemeinwesen trägt. *—————* Around the eighteenth century, several theorists came to advocate the separation of religion and state. In various ways they argued that all that concerns religion lies beyond the sphere of the state's activity. This "wall of separation" is today often understood as a matter offreedom of conscience. Wherefreedom of conscience is infringed, man 's soul is burdened beyond what the individual can bear. The separation of religion and state thus protects the inviolability of religious attitudes. However, matters of conscience are not exclusively religious. They can be moral, or even pertaining to individual worldviews beyond morality or religion. Those who want to follow thinkers like Jefferson or Humboldt must therefore go beyond their call. This paper investigates the consequences for contractarianism in the spirit of Hobbes and Locke. I suggest conscientious reservations are implied conditions for contractarian consent which oblige the commonwealth to strict neutrality in matters offreedom of conscience. To infringe uponfreedom of conscience thus destroys the band ofthe commonwealth, i.e., political, "Lockean" trust. -/- . (shrink)

As a result of the doctoral research developed by the main author (Vargas-Chaves, 2017), it was identified the evolution and perspectives of the pharmaceutical patent in the international trade system, as well as it future legal research needs in this topic, both immediate and long-term. Furthermore, a number of problems of public health were highlighted in which the patent-term-extension mechanisms have produced a lack of access to medicines.

The traditional conception of risk is probabilistic, according to which the degree of risk of an event is determined by the probability of its occurence. Recently this view was challenged by Duncan Pritchard (2015, 2016), who suggested a modal theory of risk, centered in the idea that the riskiness of events depends on the modal distance between the actual world and worlds where the event obtains. What is attractive about this theory, according to Pritchard, is that it explains our judgement (...) about cases in which two equally probable events seem to have different degrees of risk. The modal theory of risk, however, has its own shortcomings: according to Bricker (2018), there are cases in which risk judgements are not tracking modal distance; there is also the problem of determining the risk of events that occur in the actual world, since the theory seems to imply that they are maximally risky because the actual world is maximally similar to itself (EBERT; SMITH; DURBACH, 2020). The modal conception of risk is also at odds with the most natural forms of reasoning over the morality of risk imposition. I begin exploring the two conceptions of risk, emphasizing their strenghts and weaknesses. I then argue that the probabilistic conception can be defended from objections, and a pluralistic theory of risk, although less unified, deserves to be considered. -/- . (shrink)

In this text, I propose that there is an intellectual virtue not yet recognized in debates within the epistemology of virtues: intellectual rituality. To elucidate this, I expose the relevance of rituality as a moral virtue within the virtue ethics of the Confucian tradition, highlight the formulation of rituality in the work of the philosopher Xúnzǐ 荀子, analyze the meaning of moral rituality, briefly describe central elements of Sosa’s virtue epistemology, and finally, based on Sosa, Tsai, and Xúnzǐ, formulate the (...) concept of intellectual rituality and point out some of its advantages. This essay is about the relationship between the notions of practical reason, the will, and choice in Kant’s practical philosophy. Although Kant explicitly identifies practical reason and the will, many interpreters argue that he cannot really mean it on the grounds that unless they are distinct, irrational and, especially, immoral action is impossible. Other readers affirm his identification but distinguish the will from choice on the same basis. We argue that proper attention to Kant’s conception of practical reason as a (...) capacity reveals that these distinctions are neither textually grounded nor philosophically necessary. His moral psychology concerns a single capacity, practical reason, which is the will, and whose actualities in this or that individual fall under the title of choice. Practical reason is the will and choice because it is the rational faculty of desire: a rational being’s capacity to be, by means of her representations, the cause of the actuality of their objects. This, we argue, is entailed by his conception of rational action: action not just in accordance with, but in and through the representation of, principles. The possibility of irrational action is explained not by a distinction between capacities but by the finitude, and thereby the fallibility, of human reason. (shrink)

To what extent do early intuitions about ownership depend on cultural and socio-economic circumstances? We investigated the question by testing reasoning about third party ownership conflicts in various groups of three- and five-year-old children (N = 176), growing up in seven highly contrasted social, economic, and cultural circumstances (urban rich, poor, very poor, rural poor, and traditional) spanning three continents. Each child was presented with a series of scripts involving two identical dolls fighting over an object of possession. The child (...) had to decide who of the two dolls should own the object. Each script enacted various potential reasons for attributing ownership: creation, familiarity, first contact, equity, plus a control/neutral condition with no suggested reasons. Results show that across cultures, children are significantly more consistent and decisive in attributing ownership when one of the protagonists created the object. Development between three and five years is more or less pronounced depending on culture. The propensity to split the object in equal halves whenever possible was generally higher at certain locations (i.e., China) and quasi-inexistent in others (i.e., Vanuatu and street children of Recife). Overall, creation reasons appear to be more primordial and stable across cultures than familiarity, relative wealth or first contact. This trend does not correlate with the passing of false belief theory of mind. (shrink)

This paper offers a defense of veritic epistemic consequentialism, addressing its principal critiques. I argue that the core of epistemological value lies in its conduciveness to truth, rendering true beliefs intrinsically valuable. In response to the criticism that this approach may sacrifice individual truths for a greater aggregate and undervalues autonomous inquiry, I emphasize the well-connectedness of beliefs. Each belief's content is a proposition. Propositions are classified as first-order, second-order, third-order, etc., depending on what they are about. Higher-order propositions are (...) about lower-order ones. I assume that if an epistemic agent believes in p, then she tends to believe in higher-order propositions that are about p. These higher-order propositions are more structural beliefs of the agent. If p is false, then falsity may spread over the whole network through higher-order propositions about p. Thus, sacrificing a single belief may bring more damage to the network, which is not acceptable for veritic epistemic consequentialism. Regarding the issue of autonomy, epistemic acts like reflection, inference, etc. can be represented as higher-order propositions. Therefore, veritic epistemic consequentialism values them. (shrink)

A number of philosophers think that grounding is, in some sense, well-founded. This thesis, however, is not always articulated precisely, nor is there a consensus in the literature as to how it should be characterized. In what follows, I consider several principles that one might have in mind when asserting that grounding is well-founded, and I argue that one of these principles, which I call ‘full foundations’, best captures the relevant claim. My argument is by the process of elimination. In the study of education, as in many more travelled regions of Classical scholarship, democratic Athens is something of a special case. The cautions formulation is appropriate: in the case of education, surprisingly few studies have sought to establish quite how special Athens was, and those which have, have often raised more questions than they answered. The subject itself is partly to blame. The history of education invites comparison with the present day, while those planning the future of education rarely (...) fail to invoke the past. The place of Classical Athens in European culture has ensured a place for Athenian education in almost every debate from the relation between education and democracy to the value of educationversustraining, and as the original champion of causes as varied as mass education, co-education, and the national curriculum. Desirable as it is to be in demand, such treatment is not calculated to produce the most circumspect account of the subject. The study of education is further hampered by the fact that our knowledge of Athenian culture is so vibrant and diverse in some ways and so partial in others. Plato and Aristophanes present a vivid fictional picture of education in the late fifth century. If we add a few passages from Xenophon and Aristotle, a large number of vases depicting men, women, and children reading, playing the lyre, and doing athletics, and one or two archaeological finds of an educational appearance, it is tempting to take the result as a clear portrait of a society at school. How are love and justice related? Iris Murdoch characterizes the former by drawing on the latter. Love, she maintains, is just attention, which in turn triggers acts of compassion. Arguably, for Murdoch, love is the most important moral activity. By engaging in love, she maintains, moral agents progress on their journey from appearances to reality. Through love, they overcome selfish leanings, acquire a clearer vision of the world and, importantly, other individuals, which in turn enables them to act increasingly well. (...) In this paper, I lay Murdoch’s account of love alongside of Aristotle’s notion of philia. Ultimately, I argue that both Murdochian love and Aristotelian philia are crucial for enabling moral progress. I proceed as follows: First, I introduce Murdoch’s view. I then propose a novel reading of an argument from Aristotle’s Nicomachean Ethics in order to explain what I shall call his necessity claim (NC): philia is necessary to a flourishing life. Along the way, I point out ways in which Murdoch’s and Aristotle’s accounts are mutually illuminating. (shrink)

One of the main contentions of the framework for Responsible Innovation (RI) is that social and ethical aspects have to be addressed by deliberative engagement with stakeholders and the wider public throughout the innovation process. The aim of this article is to reflect on the question to what extent is deliberative engagement suitable for conducting RI in business. We discuss several tensions that arise when this framework is applied in the business context. Further, we analyse the place of deliberative engagement (...) in several theories of business ethics. We conclude that there remains a tension between the ideal of RI and the way in which the competitive market operates. Hence, RI scholars should reflect more critically on changes that are required in the market in order to make RI possible, modify the ideal of deliberative engagement for RI in business, or attempt to strike a balance between these two responses. Can an ugly experiment be a good experiment? Philosophers have identified many beautiful experiments and explored ways in which their beauty might be connected to their epistemic value. In contrast, the present chapter seeks out (and celebrates) ugly experiments. Among the ugliest are those being designed by AI algorithms. Interestingly, in the contexts where such experiments tend to be deployed, low aesthetic value correlates with high epistemic value. In other words, ugly experiments can be good. Given this, we should conclude (...) that beauty is not generally necessary or sufficient for epistemic value, and increasing beauty will not generally tend to increase epistemic value. (shrink)

Kit Fine (2000) breaks with tradition, arguing that, pace Russell (e.g., 1903: 228), relations have neither directions nor converses. He considers two ways to conceive of these new "neutral" relations, positionalism and anti-positionalism, and argues that the latter should be preferred to the former. Cody Gilmore (2013) argues for a generalization of positionalism, slot theory, the view that a property or relation is n-adic if and only if there are exactly n slots in it, and (very roughly) that each slot (...) may be occupied by at most one entity. Slot theory (and with it, positionalism) bears the full brunt of Fine's (2000) symmetric completions and conflicting adicities problems. I fully develop an alternative, plural slot theory (or pocket theory), which avoids these problems, key elements of which are first considered by Yi (1999: 168 ff.). Like the slot theorist, the pocket theorist posits entities (pockets) in properties and relations that can be occupied. But unlike the slot theorist, the pocket theorist denies that at most one entity can occupy any one of them. As a result, she must also deny that the adicity of a property or relation is equal to the number of occupiable entities in it. By abandoning these theses, however, the pocket theorist is able to avoid Fine's problems, resulting in a stronger theory about the internal structure of properties and relations. Pocket theory also avoids a serious drawback of anti-positionalism. (shrink)

Synthetic biologists aim to generate biological organisms according to rational design principles. Their work may have many beneficial applications, but it also raises potentially serious ethical concerns. In this article, we consider what attention the discipline demands from bioethicists. We argue that the most important issue for ethicists to examine is the risk that knowledge from synthetic biology will be misused, for example, in biological terrorism or warfare. To adequately address this concern, bioethics will need to broaden its scope, contemplating (...) not just the means by which scientific knowledge is produced, but also what kinds of knowledge should be sought and disseminated. The immense outpouring of archaeological discoveries this past century has shed new light on ancient East Asia, and China in particular. Yet in concert with this development another, more troubling, trend has likewise gained momentum: the looting of cultural heritage and the sale of unprovenienced antiquities. Scholars face difficult questions, from the ethics of working with objects of unknown provenance, to the methodological problems inherent in their research. The goal of this Element is to encourage scholars to critically examine their (...) relationships to their sources and reflect upon the impact of their research. The three essays in this Element present a range of disciplinary perspectives, focusing on systemic issues and the nuances of method versus ethics, with a case study of the so-called 'Han board' MSS given as a specific illustration.
